Even when after the parents have separated or divorced, they are obliged to continue providing economic aid necessary for the kid's development and comfortable living. Child support can be a lump sum of money or periodic payment given by the father to the mother or guardian of the biological child. The fund will be used for the kid's education, healthcare maintenance, and daily needs following the separation or divorce.
Parents can settle for child support in two ways. One way to do it is by coming into a child support agreement where they can document an official contract as to how they would provide and care for their children. Like the binding financial agreement, it requires both parties to have an independent legal advice before signing the same.
The other way is done by a limited child support agreement, which allows the parents flexibility to determine their own financial arrangements. As opposed to the latter, it does not require them to have an independent legal advice but only requires having child support administrative assessment.
In an event when marital conflicts and parentage problems impair the ability of parents to enter into an agreement, the court allows one party to apply for a child maintenance order. Under the Family Law, the persons who are qualified to apply for a child maintenance order are the parent who has the custody of the child, guardian of the child, or the child himself. In deciding child support proceedings, the court may decide based on the income of parents, number of children in the family, and living arrangements. The Child Support Agency will then facilitate the child support arrangements and evaluate the assistance that should be provided.
Child maintenance and parental responsibilities are common problems which can arise after parents separate or divorce. It involves a lot of risk and sensitive matters that need the assistance of lawyers in order to achieve the best result for the children.
