How do I get a replacement divorce order

If you need a replacement divorce order, you will need to complete a ‘Document request form'.  The process of applying for a replacement divorce order (and the fee and processing time) depends on when you were divorced.

Divorced after 1 January 2002

If you were divorced after 1 January 2002 you will need to contact the court on 1300 352 000 to find out where to file your request and the appropriate fee.

Divorced before 1976

The current family law system was established in 1975. Prior to 1975 the individual states of the Commonwealth of Australia administered applications for and the granting of divorce. If you were divorced before 1976, you will need to contact the local court in the State or Territory in which your divorce was granted.

Divorced between 1976 and 2001

If you were divorced between 1976 and 2001, your divorce records may be archived. To find out where to file your request – and the appropriate fee payable, you will need to contact the Court on 1300 352 000.

How long will it take to get a replacement divorce order?

If your divorce file is archived it can take 7–10 working days (from the day the Court receives your request) to receive your divorce order by post. If you need your divorce order urgently, you can request urgent processing which can take up to 3 days. An additional fee will be payable in these circumstances.

If your divorce was granted after 2001 you can obtain your divorce order by attending a family law registry, where, on provision of the document request form and payment of the fee, your request will be processed on the spot. If you can't attend a registry, you can post the form and the requisite fee to:

If you are unable to attend a registry but need your divorce order urgently, send your request in an express post envelope, and include another self-addressed express post envelope to help speed up the process.
